By accessing and using VibeCaaS ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.

2. Service Description

VibeCaaS provides an AI-powered development platform that includes:

  • AI-assisted code generation, testing, and deployment
  • Cloud-based development environments
  • Project hosting and live preview capabilities
  • Collaboration tools and version control
  • Integration with various AI models and services

3. User Accounts

3.1 Registration: You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials.

3.2 Account Security: You are responsible for all activities that occur under your account. Notify us immediately of any unauthorized use.

3.3 Age Requirement: You must be at least 13 years old to use the Service. If you are under 18, you must have parental consent.

4. Acceptable Use

You agree not to use the Service to:

  • Violate any laws or regulations
  • Infringe upon intellectual property rights
  • Distribute malware or harmful code
  • Engage in cryptocurrency mining
  • Attempt to gain unauthorized access to systems
  • Harass, abuse, or harm others
  • Overwhelm our infrastructure with excessive requests

5. Intellectual Property

5.1 Your Content: You retain ownership of the code and content you create using the Service. You grant us a license to host, display, and process your content as necessary to provide the Service.

5.2 Our Property: The Service, including its design, features, and technology, is owned by VibeCaaS and protected by intellectual property laws.

5.3 AI-Generated Content: Code and content generated by AI features are provided as-is. You are responsible for reviewing and testing all AI-generated output.

6. Payment Terms

6.1 Billing: Subscription fees are billed in advance on a monthly or annual basis. All payments are processed through Stripe.

6.2 Refunds: We offer a 14-day money-back guarantee for new subscriptions. After this period, fees are non-refundable.

6.3 Price Changes: We may adjust pricing with 30 days notice. Your current pricing is locked in for the duration of your subscription term.

7. Service Level Agreement

7.1 Uptime: We strive for 99.9% uptime for the Service, excluding scheduled maintenance.

7.2 Support: We provide support based on your subscription tier, with response times varying by plan.

7.3 Data Backup: We perform regular backups, but recommend you maintain your own backups of critical data.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIBECAAS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify and hold VibeCaaS harmless from any claims, damages, or expenses arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

10. Termination

10.1 By You: You may terminate your account at any time through your account settings.

10.2 By Us: We may suspend or terminate your account for violation of these Terms or for extended inactivity.

10.3 Effect: Upon termination, your right to use the Service ceases. You may export your data within 30 days of termination.

11. Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of San Francisco County, California.
